Bill: SB 5322 (HB 1598) — 2017
Concerning agreements between dentists and third parties that provide supportive services to dentists (King, Frockt, Miloscia)
Authorizes a dentist or group practice of dentists to enter into an agreement with a third party for the provision of services in support of a dental practice office as long as certain standards are met.
EFFECT OF CHANGES MADE BY HEALTH CARE COMMITTEE (First Substitute):
Removes requirements that:
-an agreement set out in writing covering all of the services being offered by the third party;
-the compensation paid to the third party over the term of the agreement be set in advance, be consistent with the fair market value of arm's-length transactions, and does not take into account the volume or value of any referrals between the parties;
-patients of the dentist or group of dentists are fully informed of the agreement; and
-leases for space or equipment be independent of management or personal service agreements.
Removes specified whistleblower protections.
Removes DQAC subpoena authority
