Expanding the classes of persons who may provide informed consent for certain patients who are not competent to consent (Kilduff, Rodne)
AN ACT Relating to expanding the classes of persons who may provide informed consent for certain patients who are not competent to consent; and amending RCW 7.70.065.
EFFECT OF CHANGES MADE BY 1ST SUBSTITUTE
(1) Requires an unrelated person providing a declaration to attest that he or she is not aware of a person in a higher priority class available and willing to provide informed consent to healthcare on behalf of the patient. (2) Provides that family members added to the list of persons authorized to provide informed consent for a patient who is incapacitated or not competent to make healthcare decisions must be familiar with the patient.
EFFECT OF HOUSE FLOOR AMENDMENTS
Excludes an owner, administrator, or employee of a nursing home from providing informed consent. Excludes a person who receives compensation to provide care to the patient from providing informed consent.
SENATE COMMITTEE (Law & Justice) STRIKER AMENDMENT
An informed decision to request or obtain medication to end a qualified patient's life may not be obtained by persons authorized to provide informed consent on behalf of an incapacitated person as defined in chapter 11.88 RCW.
