Protecting personal information regarding sexual harassment claims ( Jinkins, Stambaugh, Fitzgibbon)

Exempts the following from public inspection and copying under the public records act: The personal information of an agency employee who has made a claim with the agency of sexual harassment and has requested that his or her personal information not be disclosed without his or her consent. Subjects a person to civil liability if he or she: (1) Requests and obtains the personal information of an agency employee that has made a claim of sexual harassment; and (2) Uses the information to harass, stalk, threaten, or intimidate that employee.

EFFECT OF CHANGES MADE BY 1ST SUBSTITUTE
(1) Replaces "personal information" with "identity or identifying information" in relation to information exempt from disclosure pertaining to an agency employee who has made a claim with the employing agency of sexual harassment. (2) Makes the name of the agency employee who makes a sexual harassment claim subject to disclosure if the employee receives a monetary settlement from the agency arising out of the claim for sexual harassment. (3) Requires the public records exemptions accountability committee to submit a report by January 1, 2023, with recommendations regarding the continuation of the exemption from the public records act relating to personal information of an agency employee who has made a claim with the employing agency of sexual harassment.
